This Agreement (“Agreement”) is made and entered into by and between FASHION KINETICS and CUSTOMER’S NAME (Each a “Party and collectively the “Parties”) In consideration of premises and mutual premises, set forth herein, the Parties, intending to be legally bound, hereby agree as follows:
SECTION 1: CUSTOMER’S INFORMATION
When customers purchase from Fashion Kinetics’ website, information such as name, contact details, email, and delivery address are only for the process of buying and selling the product. Upon browsing, an internet protocol (IP) that informs about the browser and operating system is used by the customer. FASHION KINETICS also offers email marketing (also known as newsletter) with the permission of the customer from the subscription in order to know more about the store, new collections, and other information on this website.
SECTION 2: CUSTOMER’S CONSENT
By providing personal information upon ordering, customer identification, payment transactions, shipment, and delivery, the customer/s agreed that we collect and handle that information for that precise purpose alone. SECTION 3: DISCLOSURE OF INFORMATION
In case of disagreement regarding any matter covered by this Agreement or if a breach of contract occurred, the Parties shall first seek to resolve the dispute or breach through informal discussions. In any obligation by law or by any chance that a customer breached our Terms of Service, we may disclose their personal information. In the event, any dispute or breach cannot be resolved informally within 30 consecutive days, the dispute or breach will be negotiated between parties through mediation if the Parties can agree on a mediator. The costs of mediation shall be shared equally by the Parties. Neither Party waives its legal rights to adjudicate this Agreement in a legal form.
SECTION 4: WEBSITE
FASHION KINETICS is hosted via Wix.com as an online eCommerce platform that allows the brand to sell its products and services. Our customer databases, data storage, and website application is secured and protected by a firewall.
Payment:
For Non-Cash on Delivery / International Shipping, kindly settle your payment within 24 hours from placement of order. Submit your proof of payment through the Contact Us button on the lower right side of the screen. Orders under non Cash on Delivery will be shipped out via J&T Express while orders under International Shipping will be shipped out via LBC Express.
For Cash on Delivery (nationwide only), kindly upload a valid I.D for proof of transaction purposes within 24 hours through the Contact Us button on the lower right side of the screen. Upon delivery, pay the amount stated on the order confirmation email that will be sent after confirming your order. Orders under Cash on Delivery will be shipped out through J&T Express.
For Express Shipping, (payment first basis) kindly settle your payment within 24 hours and upload your proof through the Contact Us button located on the lower right side of the screen. An email containing our location details will be sent once the order is ready for pick-up.
Note: The customer shall shoulder pick-up fees and be the one to book the express shipping courier of your choice. (Grab Express, Mr. Speedy, Lalamove, etc.)
SECTION 5: THIRD-PARTY SERVICES
FASHION KINETICS does not engage with any third-party services that collect and disclose our customer’s information for an extended execution of service except for worldwide shipping via LBC, an international shipping courier.

Upon clicking on FASHION KINETICS website, the customers may be redirected to a separate link possibly for payment purposes, store catalog viewing, blog postings, lookbooks, and other pages from the website only. Otherwise, FASHION KINETICS is unsusceptible if any information is disclosed using a different link that is not associated with the brand itself.
SECTION 6: SECURITY
FASHION KINETICS takes precautions that are necessary and reasonable which ensures the safety and confidentiality of the customer. Once we are provided with personal information, FASHION KINETICS security is entered via Wix Site and does not use any external third-party apps for the safety of the customer’s information.
The Parties agree that each shall treat confidentiality the terms and conditions of this Agreement and all information provided by each Party to the other regarding its business and operation (“Confidential Information”). Confidential Information provided by a party shall be used by the Party solely for the purpose of rendering or obtaining services pursuant to this Agreement.
SECTION 7: AGE OF CONSENT
Customers ages 15 years and above may view and access the website with a given consent while those under the age of 15 are obliged by specific legal obligations under state, federal, and international law that impacts the brand’s Privacy and Policy.
SECTION 8: PRIVACY AND POLICY MODIFICATIONS
Customers are asked to review FASHION KINETICS’ Privacy and Policy due to immediate amendments upon posting on the website. Also, a notification would be disseminated if there are certain changes to this policy to let our customers understand what information we collect, how we use it, and under what circumstances we use and/or disclose it, if any.
If our business is sold or merged with another company, your information may be passed to the former owners so that you may continue to patronize small and local businesses.
